Terms of Use
Last Updated: October 8, 2026
Welcome to My Footsteps™. These Terms of Use ("Terms") govern your access to and use of the My Footsteps™ website, application and related services (collectively, the "Services"), operated by The Memorial Collective Inc. ("we," "us," or "our").
By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. About My Footsteps™
My Footsteps™ is a digital remembrance platform that allows individuals to create and preserve personal messages, stories, memories and photos associated with geographic locations.
Users may designate recipients who can discover these memories when they reach the associated location and any applicable availability conditions have been satisfied.
The Services are intended to help people preserve meaningful connections and allow loved ones to follow in their footsteps through the places and experiences of their lives.
2. Eligibility and Accounts
To use certain features, you may be required to create an account.
You agree to:
- Provide accurate and current registration information.
- Maintain the confidentiality of your login credentials.
- Accept responsibility for activities conducted through your account.
- Notify us promptly if you suspect unauthorized access.
- Use the Services only for lawful purposes.
You must be at least 18 years old to create an account, unless we expressly permit another arrangement in accordance with applicable law.
We reserve the right to suspend or restrict accounts that violate these Terms.
3. Creating and Sharing Memories
My Footsteps™ allows eligible users to create location-based memories containing written messages, stories and photographs.
Depending on available features, users may be able to:
- Associate a memory with a geographic location.
- Select the geographic area within which it may be revealed.
- Designate one or more recipients.
- Add optional hints about the location.
- Specify a date and time before which a memory may not be revealed.
- Review and confirm their selections before saving.
You are responsible for ensuring that the information and content you submit are accurate, appropriate and authorized for sharing.
We do not guarantee that a recipient will visit the designated location or discover a particular memory.
4. Location-Based Services
My Footsteps™ relies on location technologies to associate memories with physical places and determine when certain content may become available.
By enabling location-based functionality, you acknowledge that:
- Location permissions may be required on your device.
- Location accuracy may vary depending on GPS signals, device settings, network conditions and environmental factors.
- Messages may not become available at the precise geographic point originally selected.
- Some features may not operate correctly when location permissions are disabled.
- Availability may depend on internet connectivity and compatible devices.
You must never enter restricted, dangerous or private property, disregard safety instructions or violate applicable laws to access a location-based memory.
Your personal safety always takes priority over discovering content.
5. Recipients and Message Availability
Users may designate individuals to receive location-based memories.
Depending on the features selected, a memory may become available when the recipient reaches a designated geographic area, satisfies a time-based restriction, or meets other applicable conditions.
You acknowledge that:
- Recipients may need an account to access their messages.
- Delivery and availability depend on the operation of the Services.
- Location and timing conditions may affect when content can be accessed.
- We cannot guarantee that a message will be discovered or accessed at a particular time.
- A recipient's ability to access content may be affected by account status, device compatibility or service availability.
We are not responsible for circumstances beyond our reasonable control that prevent a recipient from accessing a memory.
7. Your Content and Ownership
You retain ownership of the original content you create and upload, including your written messages, stories and photographs, subject to any third-party rights.
By submitting content, you grant The Memorial Collective Inc. a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit and display that content solely as reasonably necessary to operate, maintain and provide the Services, including making it available to your designated recipients.
This licence does not transfer ownership of your content to us.
You represent that you have the necessary rights and permissions to upload and share the content you submit.
You must not upload material that infringes another person's intellectual property, privacy or other legal rights.
8. Privacy and Personal Information
We recognize that memories, personal messages, photographs and location information may be sensitive.
Our collection, use, disclosure and protection of personal information are described in our Privacy Policy, which should be read alongside these Terms.
By using the Services, you acknowledge that certain personal information, including location information and recipient details, may be processed to provide the features you request.
You should avoid including highly sensitive personal information about other individuals without appropriate authorization.

- Share unlawful, defamatory or deliberately harmful content.
- Violate another person's privacy or intellectual property rights.
- Impersonate another individual.
- Upload malicious software or interfere with the operation of the Services.
- Create messages intended to facilitate stalking, unwanted surveillance or unsafe physical encounters.
- Encourage recipients to enter unsafe or restricted locations.
- Use the platform for fraudulent or otherwise unlawful activities.
We may remove content, restrict access or suspend accounts where reasonably necessary to address violations, protect users or comply with legal obligations.
10. Content Preservation and Service Availability
We understand that content stored through My Footsteps™ may carry significant emotional value.
While we aim to provide reliable access to the Services, no digital platform can guarantee permanent, uninterrupted or error-free storage.
You acknowledge that:
- Technical interruptions, maintenance and unexpected failures may occur.
- Certain features may be modified or discontinued.
- Content accessibility may depend on continued account and service availability.
- We cannot guarantee that content will remain accessible indefinitely.
We encourage users to retain independent copies of important photographs, written memories and other irreplaceable material.
We will handle changes affecting stored personal information in accordance with our Privacy Policy and applicable law.
11. Account Closure and Content Removal
You may request assistance with closing your account or managing your personal information by contacting us.
Requests to delete personal information will be handled in accordance with our Privacy Policy and applicable legal requirements.
Certain information may need to be retained where required by law or for legitimate operational purposes.
Because memories may be intended for future recipients, account closure or content deletion could affect their availability. Any applicable consequences should be communicated through the relevant account-management process.
12. Intellectual Property
The My Footsteps™ name, website design, branding, graphics, software, text and other platform materials are owned by or licensed to The Memorial Collective Inc., except for content belonging to users or other rights holders.
These Terms do not grant permission to reproduce, distribute, modify or commercially exploit our intellectual property without prior written authorization.
All rights not expressly granted are reserved.
13. Third-Party Services
The Services may rely on third-party providers for functions such as hosting, mapping, payment processing, email delivery and technical infrastructure.
We are not responsible for the independent terms, policies or practices of third-party services.
Where applicable, your use of certain third-party services may also be subject to their respective terms and privacy policies.
14. Disclaimer of Warranties
To the extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis.
We do not guarantee uninterrupted operation, continuous accessibility, precise location detection or successful delivery and discovery of every message.
We also do not guarantee that the Services will meet every user's expectations or emotional needs.
Nothing in these Terms excludes warranties, guarantees or other rights that cannot lawfully be excluded under applicable consumer protection legislation.
15. Limitation of Liability
To the extent permitted by applicable law, The Memorial Collective Inc. will not be liable for indirect, incidental, special or consequential losses arising from the use or inability to use the Services.
This may include loss of access to content, service interruptions, location inaccuracies or failure of a recipient to discover a message.
Nothing in these Terms limits liability that cannot legally be limited or excluded, including liability arising from conduct for which exclusion is prohibited by law.
16. Changes to the Services or Terms
We may update the Services or these Terms to reflect changes in functionality, business operations, legal requirements or security practices.
The updated Terms will be published on our website with a revised effective date.
Where required by law, we will provide additional notice or obtain consent before material changes take effect.
17. Governing Law
These Terms are governed by the applicable laws of the Province of Ontario and the federal laws of Canada applicable therein, subject to any mandatory consumer protection rights or other applicable legal requirements.
